We received your valid DMCA counter-notice in response to the DMCA notices of alleged infringement against you sent by Xavier Smith on 12/23/09. As you are aware, Ning is an online service provider that provides a set of technology applications that enable individuals to build their own social networks. Ning is not involved in the decisions relating to content uploaded or published by Network Creators or members using our technology platform and is not in a position to determine whether or not a particular DMCA notification includes a valid claim of infringement. Ning takes the rights of intellectual property owners very seriously and, as a service provider, complies with all applicable provisions of the Digital Millennium Copyright Act (“DMCA”). Our policy is to respond to valid counter-notices we receive according to the DMCA by forwarding such counter-notice to the individual who submitted the DMCA notice of alleged infringement against the content you uploaded or embedded. As required under the DMCA, we must wait at least 10 business days before either restoring access or ceasing to disable access to such content to allow Xavier Smith to file an action against you in court. If we receive notification that legal action to seek a court order has been commenced, then we will not be able to restore the content or allow you to restore the content. Please contact us at the end of the 10 business days to inform us of the status of this matter.
